Organisational Context
The International Criminal Court (ICC) investigates and, where warranted, tries individuals charged with the gravest crimes of concern to the international community: genocide, war crimes, crimes against humanity and the crime of aggression.
The Independent Oversight Mechanism (IOM) was established through ASP resolution ICC-ASP/8/Res.1 in November 2009 in accordance with Article 112(4) of the Rome Statute of the International Criminal Court, Rome Statue. Its mandate is set out in Annex II of the ASP Resolution ICC-ASP/19/Res.6 of 16 December 2020 (ASP Resolution).
Within the ICC, the IOM operates as a subsidiary body of the Assembly of State Parties (ASP) exercising operational independence under the authority of the President of the ASP. Its purpose is to provide assurance to the Assembly of the effective and comprehensive oversight of the Court in order to enhance its efficiency and economy. This is achieved through the conduct of its three-fold mandate, namely; conducting independent inspections, evaluations and investigations.
The purpose of this vacancy announcement is to establish a roster of qualified candidates who will be contracted as needed by the IOM.
Duties and Responsibilities:
• Receive, review and certify the investigative activities and reports of IOM investigators, confirming that the investigation was carried out independently, impartially and without undue influence.
• Fulfil an advisory role to the IOM investigators during the conduct of investigations.
• Lead investigations into sensitive and complex reports of misconduct received by the IOM and providing advice on appropriate course of action in consideration of the mandate of the office. A subset of this work product will require interviewing witnesses and subject, including sensitive witnesses/victims and senior staff, taking statements, obtaining, reviewing and preparing potential documentary and electronic evidence, analysing facts, conducting investigative research, determining findings and formulate recommended corrective measures.
• Prepare complete and concise investigation reports and other written outputs of the highest quality, presenting facts conclusions and recommendation to enable the Court management’s decision regarding disciplinary, administrative or other corrective actions.
Indicative level of remuneration
Remuneration is calculated at a rate commensurate with that of a Senior Investigator at the time of engagement.
Payment will be made upon the closure of each investigation the Senior Investigations Consultant is tasked with providing services and confirmation from the IOM that the work in that investigation is of sufficient quality to be considered final and could be further disseminated if necessary.
Education:
- Advanced university degree in investigations, law, business administration, finance or another directly relevant field, or significant relevant training and experience in the field of investigations in lieu of an advanced university degree.
- A combination of formal professional training from a national law enforcement or investigations academy or equivalent, and at least 3 years’ additional experience in conducting administrative investigations as an investigator (in addition to the 12 years of investigation experience required below) may be accepted in lieu of an advanced degree.
Experience:
- At least 12 years’ experience in the field of administrative or criminal investigations is essential.
- A high level of skill in preparing investigation-related documents is essential.
- Experience in the editing and quality control of documents of an investigative or legal nature is an advantage.
- Working experience in the field of administrative or criminal investigations with an International Organization is desirable.
- Investigation experience in the field level is desirable.
Languages:
- Proficiency in one of the working languages of the Court, English or French is required. Proficiency or working knowledge of the other is strongly desired.
Other Requirements:
This assignment is of a highly confidential nature. The Consultant may not share disclose, including to other ICC staff, that s/he is conducting this assignment without prior approval by the IOM. Any document provided by the IOM to the Consultant shall be kept confidential, and either returned to the IOM or destroyed upon completion of the assignment. The Consultant will be required to sign a declaration of confidentiality.
Any output or deliverable will be the property of the IOM, and may not be shared by the Consultant with anyone, without the express written consent of an IOM relevant authority. Any output, work, or communication by the Consultant may be further disseminated by the IOM , at their discretion.
